Who needs it?

Primarily solicitors but also finance directors, tax managers or accountants.

What is it?

The capital allowances legislation gives rise to a number of documents which must be put in place for a variety of given property scenarios, for example, Section 198 elections, Section 183 elections and Section 199 elections to name but a few. Additionally, there are a number of scenarios where different contractual clauses are required, such as in purchase agreements or agreements to lease and where the correct clause wording is important if entitlement to allowances is to be protected on sale or on purchase.

Capitus has prepared a number of pro-forma documents which can be inserted into sale or purchase agreements by solicitors which will comply with all the requirements of the relevant legislation. Additionally, we have a document pack of contractual clauses for a wide variety of property scenarios including situations where the seller wishes to retain entitlement to capital allowances, or a landlord is making a contribution to a tenant's fit out.
